WANPRESTASI ANTAR PERUSAHAAN STUDI PUTUSAN PN SURABAYA NOMOR 1259/PDT.G/ 2023/PN SURABAYA

Penelitian ini mengakaji sengketa wanprestasi anata PT Rolas Nusantara Tambang dan PT Merak Beton Perkasa berdasarkan Putusan Nomor 1259/Pdt.G/2023/PN Surabaya akibat gagal bayar pembelian batu andesit senilai Rp 791.385.542. Dengan pendekatan hukum normatif, penelitian meniai hubungan hukum para pihak, kekuatan alat bukti, serta penerapan Pasal 1234, 1238, dan 1338 KUH Perdata. Hasilnya, pengadilan menyatakan tergugat wanprestasi karena tidak memenuhi kewajiban pembayaran sesuai kontrak, sementara sebagian bukti tergugat dikesampingkan karena tidak relevan. Putusan hakim dinilai tepat dan mencerminkan kepastian hukum serta pentingnya pengelolaan kontrak yang baik dalam dunia usaha.
